Your privacy is very important to BiOSS (“BiOSS” or “we”), and maintaining the trust of our customers remains our priority. This Privacy Policy (the “Privacy Policy”) has been prepared to affirm our commitment to protecting the confidentiality of the information we hold about our customers and to inform you about our practices regarding the collection, use and disclosure of personal information that you provide to us or that we automatically collect through our website, bioss.ca (the “Site”).

This Privacy Policy applies whenever you provide us with personal information, including when visiting our Site, creating an account, placing an order through our online store, participating in a contest or at any other time while using our Site; when communicating with us in writing; subscribing to our newsletter; contacting us by telephone; or at any other time when BiOSS collects, uses, discloses or retains your personal information. By providing us with your personal information or using our Site, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy.

Section 1 – Collection of Personal Information

We may collect and process various types of personal information in connection with our business activities and the provision of our services, including, without limitation, your first and last name, billing address, shipping address, email address, telephone number, gender, date of birth, credit card number, payment information, responses to questionnaires and surveys, product preferences, comments, transaction-related information and any other personal information you provide to us.

You may be asked to provide personal information in various circumstances, including when you make a purchase, contact us regarding an order or return, create an account on our Site, participate in a loyalty program, or enter a contest or promotion.

In addition to the information you provide directly, we also automatically collect certain technical information, such as information about your use of our Site or your device, including, without limitation, browser version, IP address, time zone, cookie information, websites or products you view, search terms and how you interact with the Site. For more details, please refer to Section 4 – “Information Collected Automatically” below.

For the purposes of this Privacy Policy, any information that may uniquely identify an individual, including, without limitation, the information described above, is referred to as “personal information.”

Section 2 – Use of Personal Information Collected

We may use the personal information collected for any of the following purposes:

Purchases and order management: To validate, process and track your order, including delivering the products you purchased; communicate with you regarding the status of your orders; assist you with transactions, such as helping you place an order or return a product; assess your satisfaction; verify your identity and credit where necessary; process payment information; review orders for potential risks or fraud; collect amounts owed; and manage disputes relating to purchases.
Creation and management of an online account: To allow you to manage your orders, promotions or contests in which you are registered; provide you with a loyalty program; and allow you to manage your preferences and enhance your profile.
Customer service: To respond to questions regarding your account and orders; interact with you; or connect you with the appropriate services.
Promotion and marketing of our products: To provide you with personalized commercial offers; personalize your experience on our Site, including displaying content tailored to your interests or needs; understand your opinions, interests, preferences, suggestions and comments regarding our products and services; continuously improve our products and services so they meet your expectations; compile anonymized customer statistics; and evaluate the success of our advertising campaigns.
Newsletter and other commercial communications: To send you news about BiOSS and our products; inform you about new products; send you offers and promotions; adapt and personalize our marketing communications; and evaluate the success of our newsletter and commercial communications.
Operation of the Site: To provide you with a high-performing Site and facilitate your browsing experience, including keeping you logged in and retaining products in your shopping cart.
Promotion of other products and services: To inform you about products and services offered by other companies that may be of interest to you.
Legal requirements: To comply with applicable legal and regulatory requirements.

Should we need to collect personal information for purposes other than those identified above, we undertake to inform our customers in advance and obtain any authorizations required for the collection, use and disclosure of such personal information, where applicable.

Section 3 – Sharing of Personal Information

BiOSS does not disclose your personal information for purposes other than those for which it was collected, unless we obtain your consent or are required to do so by law.

Section 3.1 – Third-Party Service Providers

Personal information may be shared with certain third parties, such as Shopify, our e-commerce platform provider, which we use to operate our online store. You can learn more about how Shopify uses your personal information by reviewing Shopify’s Privacy Policy.

Personal information may also be shared with third parties that provide us with IT services, marketing-related services, program management services (such as loyalty programs, where applicable), and services related to certain aspects of our business operations, including third parties such as Canada Post, Shopify, PayPal and others.

These third parties may have access to or process personal information as part of the services they provide to us. We limit the information we provide to them to what is reasonably necessary for them to perform their functions, and our agreements with these service providers require them to maintain the confidentiality of the information disclosed to them.

Section 3.2 – Government Authorities and Law Enforcement Agencies

We may share your personal information in order to comply with applicable laws and regulations, respond to a subpoena, search warrant or other lawful request for information that we receive, or otherwise protect our rights.

For greater certainty, we may disclose personal information and other information when required by law or when we believe in good faith that such disclosure is necessary to comply with applicable laws.

Section 3.3 – Entities Within the BiOSS Corporate Network

We may share your personal information, where necessary, with an entity resulting from an acquisition, merger or other corporate restructuring involving BiOSS.

Section 3.4 – Behavioural Advertising

In order to provide you with targeted advertisements or commercial communications that we believe may be of interest to you, we use certain information concerning your use of the Site, your purchases and your interactions with our advertisements on other websites.

We collect and share this information directly with our advertising partners and, in some cases, through the use of cookies or similar technologies, which you may accept depending on your location. For additional information, please refer to Section 4 – “Information Collected Automatically” below.

By accessing our Site, you consent to this collection, use and disclosure of your information. To exercise your rights or opt out of certain uses or disclosures by our advertising partners, you must opt out directly through those third-party services by following their instructions.

We use Google Analytics to help us understand how our customers use the Site. You can learn more about how Google uses your personal information through Google’s privacy resources. You may also opt out of Google Analytics.

We use Facebook to help us understand how our customers interact with social media.

For more information about how targeted advertising works, you may consult the educational resources provided by the Network Advertising Initiative (“NAI”). You may opt out of targeted advertising from Facebook, Google and Bing by visiting their respective advertising preference pages.

You may also opt out of certain services through the Digital Advertising Alliance’s opt-out portal.

Section 4 – Information Collected Automatically

This section provides information regarding the collection, use and disclosure of information that is automatically collected through tracking technologies when you access our Site, including cookies, log files, web beacons, tags and pixels.

The tracking technologies used by our Site do not necessarily collect information that directly identifies our customers, but instead collect general information regarding how customers access and use the Site.

By using our Site, you consent to the automatic collection, use and disclosure of the information described in this section in accordance with this Privacy Policy or as otherwise permitted by law.

Section 4.1 – De-Identified Statistical Information

As is the case with most websites, our Site automatically collects certain de-identified statistical information relating to its use. This information is considered “de-identified” because it cannot be linked to a specific individual.

The de-identified statistical information we collect may include the approximate location (city or neighbourhood) associated with browser IP addresses, the date and time visitors access the Site, the operating system they use, the sections of the Site they visit and the webpages they view.

De-identified statistical information is used for system and Site administration purposes and to improve our Site. It may be disclosed to third parties (see Section 3 – “Sharing of Personal Information”) and may be permanently archived for future use.

Section 4.2 – Cookies

A cookie is a small amount of information downloaded to your computer or device when you visit our Site.

We use several types of cookies, including functional, performance, advertising, social media and content cookies.

Cookies serve several purposes. For example, they improve your browsing experience by allowing the Site to remember your actions and preferences, such as login information and region selection. This means you do not need to re-enter this information every time you return to the Site or navigate from one page to another.

Cookies also provide information about how people use the Site, such as whether they are first-time or frequent visitors.

In addition to our own cookies, we allow third parties to place cookies on our Site. For example, like many companies, we use third-party analytics tools to monitor traffic on our Site for marketing purposes and to personalize our customers’ web experience.

If you use our Site without disabling cookies, you implicitly consent to the collection, use and disclosure of the information, whether personal or otherwise, required for these features to function.

For greater certainty, we use various cookies to optimize your experience on our Site and provide our services.

Section 4.2.1 – Reporting and Analytics

The length of time a cookie remains on your computer or mobile device depends on whether it is a “persistent” or “session” cookie.

Session cookies remain active until you stop browsing, while persistent cookies remain until they expire or are deleted. Most cookies we use are persistent and expire between 30 minutes and two years from the date they are downloaded to your device.

Section 4.2.2 – Do Not Track

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when such a signal is detected from your browser.

Section 4.3 – Web Beacons

We use web beacons, which are transparent graphic images placed on a webpage or in an email that indicate that a page or email has been viewed or instruct your browser to retrieve certain content from another server.

These beacons collect statistics regarding the use of our Site and web services, allowing us, among other things, to evaluate the success of our newsletter, advertisements and communications.

Section 4.4 – Google Web Analytics Products

As mentioned above, we use certain Google products, including Google Analytics, as web analytics tools.

These products allow us to adapt, optimize and deliver advertisements based on your previous visits to our Site, including displaying BiOSS advertisements that may be of interest to you on other websites.

Google Analytics uses cookies and web beacons (as described above) to optimize its analytics. By visiting our Site, you consent to our use of Google Analytics.

If you do not agree with this use and do not wish to transmit information to Google Analytics, you may use Google’s opt-out tools or refer to the instructions in Section 3.4 – “Behavioural Advertising.”

Section 5 – Newsletter and Other Commercial Communications

We send commercial communications only for the purposes described in Section 2 – “Use of Personal Information Collected.”

These communications may be sent to you by mail, email, text message or any other means of communication, subject to obtaining your consent in accordance with this Privacy Policy and applicable laws.

We have a newsletter that we send to customers or users who subscribe to it. It is an electronic communication sent by email that provides information about our overall sustainability approach, our offers and promotions, the latest trends and other information.

You may subscribe at any time by completing the subscription form available on our Site. You may unsubscribe from the newsletter at any time by updating your preferences in your online account or following the unsubscribe instructions located at the bottom of each newsletter.

Please note that operational emails are not commercial electronic messages and provide relevant information that must be communicated to you, such as information regarding purchases you have made. Accordingly, BiOSS will continue to send such messages when appropriate.

Section 5 – Security Measures to Protect Personal Information

BiOSS maintains appropriate physical, technical and administrative safeguards and follows industry best practices to protect personal information in our possession against accidental destruction or destruction contrary to applicable laws, accidental loss, unauthorized disclosure or access, misuse or any other unlawful processing of personal information.

BiOSS limits access to your personal information to employees who require access in order to perform their duties.

Paper records containing personal information are stored in a secure environment with restricted access. Personal information stored electronically is protected through technical and technological measures such as passwords, firewalls, antivirus software and other security software, as well as encryption of certain data to help prevent loss, theft, unwanted intrusions, misuse, unauthorized modifications and malicious attacks.

BiOSS ensures that its servers are maintained in a secure environment and that its IT infrastructure is managed by specialists responsible for protecting data. All BiOSS employees who have access to personal information are trained and made aware of the importance of protecting the confidentiality of personal information.

With respect to credit card transactions, BiOSS complies with industry best practices to protect personal information relating to credit cards.

However, no company, including BiOSS and our partner Shopify, can completely eliminate the security risks associated with transmitting personal information through online transactions, and you understand that you do so at your own risk.

Despite all precautions and measures implemented by BiOSS to protect your personal information, risks associated with security and confidentiality cannot be completely eliminated due to the nature of the Web and related technologies.

Accordingly, BiOSS cannot guarantee that your personal information will never be disclosed in a manner contrary to this Privacy Policy. If you have reason to believe that personal information has been compromised, please contact us using the information provided in the “Questions, Complaints and Contact Information” section.

Section 6 – Retention of Your Personal Information

We will retain personal information only for as long as necessary to fulfill the purposes set out in this Privacy Policy and to comply with our legal and regulatory obligations.

Section 7 – Access to Your Personal Information

In accordance with applicable laws, you have the right to request access to all personal information that BiOSS holds about you, to learn how that information has been used and to determine whether it has been disclosed to third parties.

You also have the right to request the correction or deletion of personal information that is inaccurate or incomplete.

Your request must provide sufficient information for us to clearly identify you and provide you with information regarding the existence, use and disclosure of the personal information we hold about you.

BiOSS will review the written request and respond within the timeframe prescribed by applicable law. This period may be extended by an additional thirty (30) days where permitted by law.

BiOSS does not charge a fee for processing such a request unless the request is complex.

BiOSS reserves the right to refuse a request in circumstances where permitted by law. Where applicable, the reasons for the refusal will be provided within the applicable response period, and you will be informed of any remedies available under the law.

Section 8 – Age of Consent

By using this Site, you represent that you are at least the age of majority in your state or province of residence, or that you have provided us with your consent to allow any minor under your responsibility to use this Site.

We do not knowingly collect personal information from minors.

Section 9 – Other Websites

Our Site may contain hyperlinks to websites that are external to BiOSS. By clicking these hyperlinks, you will automatically be directed to those websites.

Although we make efforts to include links only to websites that maintain high standards for privacy protection, our Privacy Policy no longer applies once you leave our Site.

We cannot ensure the protection of information that you provide or that is collected through tracking technologies, such as cookies or similar technologies, while you use these websites because they are owned and operated by independent third parties.

These websites have their own privacy and personal information protection practices that are beyond our control.

BiOSS assumes no responsibility or liability whatsoever for the practices, actions or policies of these third-party websites.

We therefore recommend reviewing the privacy statements of these websites to understand how your information may be collected, used, shared and disclosed.

Section 10 – Updates

We may update this Privacy Policy from time to time, without prior notice, in order to reflect changes in our practices or for other operational, legal or regulatory reasons.

We encourage you to review the date on which this Privacy Policy was last updated.

By continuing to provide personal information to BiOSS, use its Site or place orders after a revised Privacy Policy has been posted, you are deemed to have read and accepted the changes made to the Privacy Policy.

We therefore encourage you to periodically review this Privacy Policy to remain informed about how we process personal information.
